The work permit: earning a living while your case is pending

What the EAD is and why family applicants file for it
Filing an I-485 does not by itself let you work. The Employment Authorization Document, category C09 for adjustment applicants, is what bridges the gap between filing and the green card. Because family adjustment commonly runs 12 to 24 months as of July 2026, that bridge matters: it is the difference between contributing a paycheck during the wait and sitting out a year or more of your working life.
Almost every adjustment applicant should file the I-765 in the same envelope as the I-485 package. Filed with or based on a pending I-485, the fee is $260. Filed standalone on other bases, it costs $520 on paper or $470 online, which is one more reason to bundle it. Like all USCIS fees since October 28, 2025, payment is electronic only.
What the card actually lets you do
An EAD is open-market work authorization: any employer, any industry, full or part time, or self-employment. You present it for the I-9 like any other work document. On the I-765 you can also ask the Social Security Administration to issue your Social Security number automatically, so the SSN card arrives without a separate office visit. That number, in turn, unlocks ordinary life: payroll, credit, a driver’s license in many states, and tax filing in your own name, which itself becomes a positive equity in a case decided under the 2026 discretion standard.
One thing the EAD is not: a travel document. Leaving the country requires advance parole, and leaving without it abandons the pending I-485.
The 18-month card and renewal strategy
Since December 5, 2025, new C09 EADs are issued with 18-month validity, shorter than the cards issued in recent years. With adjustment cases commonly running 12 to 24 months, the practical consequence is simple: many applicants will need to renew mid-case. A renewal is another I-765 (still $260 while based on the pending I-485), and the timing is the strategy.
Calendar the renewal on day one. When the first card arrives, note its expiration and plan to file the renewal well before that date. A timely-filed renewal triggers an automatic extension period of your existing work authorization, so a pending renewal does not have to mean a forced unpaid leave. But the extension only attaches to a renewal filed before the old card expires, so a late filing forfeits the safety net.
Employers see this correctly when it is documented correctly: the expiring card plus the renewal receipt notice evidence the extension for the I-9. We prepare that paperwork as part of the case so nobody at HR has to guess.
When the card arrives, and the K-1 wrinkle
The EAD typically arrives some months into the case, well before the interview; check current processing times rather than planning around a specific month, because they move. If a job offer is on the line, resist the temptation to work before the card comes. Unauthorized work is forgiven for immediate relatives of U.S. citizens at adjustment, but it is a real problem for preference-category applicants and an unnecessary negative in any file decided on discretion.
K-1 arrivals deserve a special note. A fiancé(e) who enters on a K-1 has only a 90-day window of status, and a work permit based on K-1 status alone dies with it, so it is rarely worth filing. The practical path is to marry, file the adjustment package after the K-1, and include the C09 I-765 there. That does mean a stretch of months after arrival with no work authorization: an income gap couples should budget for honestly before the wedding, not discover afterward.
